Right to withdraw from the contract

A customer who is a consumer has the right to withdraw from the sales contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 14 days from the date on which the customer came into possession of the item or on which a third party other than the carrier and indicated by the customer came into possession of the Goods.

To exercise the right to withdraw from the contract, please inform us, i.e. Krzysztof Kleszyński, conducting business activity under the name Krzysztof Kleszyński, K2Dnn.net at Siekierczyna 58, 34-600 Limanowa, e-mail: sales@k2action.eu, of your decision to withdraw from the sales contract by means of an unequivocal statement sent to us by post or e-mail to the above addresses.

The customer may use the model withdrawal form attached as Appendix 1 to the Terms and Conditions of our Online Store. Use of the model form is not mandatory.

In order to meet the withdrawal deadline, it is sufficient for the customer to send information regarding the exercise of their right of withdrawal before the expiry of the withdrawal period.

Please be advised that the right to withdraw from a distance contract does not apply to contracts specified in Article 38 of the Act of May 30, 2014, on consumer rights. This includes contracts where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individual needs.

 

Effects of withdrawal from the contract

In the event of withdrawal from this contract, we shall refund the customer all payments received from them, including the costs of delivery (except for additional costs resulting from the customer's choice of a delivery method other than the cheapest standard delivery method offered in our online store), immediately, and in any case no later than 14 days from the date on which we were informed about the decision to exercise the right to withdraw from this contract. We will make the refund using the same payment methods as those used by the customer in the original transaction, unless the customer has expressly agreed to a different solution; in any case, the customer will not incur any fees in connection with this refund.

Please be advised that we may withhold the refund until we receive the Goods or until you provide us with proof of their return, whichever occurs first.

Please return the Goods to the following address: Krzysztof Kleszyński, K2Dnn.net, Siekierczyna 58, 34-600 Limanowa, immediately, and in any case no later than 14 days from the date on which we were informed of the withdrawal from the sales contract. The deadline is met if the Goods are returned before the expiry of the 14-day period. Please be advised that the customer will be required to bear the direct costs of returning the goods.

 

WARRANTY FOR DEFECTS IN GOODS

Pursuant to Article 556 of the Act of April 23, 1964, Civil Code, the Seller is liable to the customer if the Goods sold have a physical or legal defect. The Seller is exempt from liability under the warranty if the customer was aware of the defect at the time of conclusion of the contract.

Pursuant to Article 558 of the Civil Code, in the case of the sale of Goods to a customer who is not a consumer, the Seller's liability under the warranty is excluded.

The delivery of Goods under the warranty for defects shall be at the expense of the Seller.

The Seller shall be liable under the warranty if the defect is discovered within two years from the date of delivery of the Goods to the customer. In the case of used Goods, the Seller shall be liable under the warranty for defects discovered within one year from the date of delivery of the Goods to a customer who is a consumer.

Notification of defects in the Goods should be sent by e-mail to sales@k2action.eu or in writing to the address of the Seller's registered office.

If the item sold has a defect, the customer may submit a statement requesting a price reduction or withdrawal from the contract, unless the Seller immediately and without undue inconvenience to the customer replaces the defective item with a defect-free item or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller or if the Seller has not fulfilled its obligation to replace the item with one free of defects or to remove the defect.

Instead of the removal of the defect proposed by the Seller, the customer may demand that the item be replaced with one free of defects or, instead of replacing the item, demand that the defect be removed, unless bringing the item into compliance with the contract in the manner chosen by the customer is impossible or would require excessive costs compared to the method proposed by the Seller.

The customer may not withdraw from the contract if the defect is insignificant.

If necessary for the assessment of physical defects, the Goods should be delivered to the following address: Krzysztof Kleszyński, K2Dnn.net, Siekierczyna 58, 34-600 Limanowa.

The Seller shall respond to the customer's notification within 14 days.
